Terms of Service

1. Eligibility and Account Registration

You must be at least 13 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement. If Edena Labs discovers or has reasonable grounds to believe that a user is under the age of 13, the account will be terminated immediately. The responsibility for accurate age representation lies solely with the user or, where applicable, their legal guardian.

You are responsible for safeguarding your account credentials and for all activities that occur under your account, including any actions taken by a third party who gains access to your account as a result of your failure to keep your credentials secure. You must provide accurate and complete information when registering. Edena Labs is not liable for any loss, harm, or damage resulting from unauthorized access to your account caused by your failure to maintain the confidentiality of your login credentials.

1.1 Account Termination and Data Retention

Edena Labs reserves the right to suspend or permanently terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. You may also voluntarily delete your account at any time through the Service.

Upon account deletion, your profile and content are removed from public access immediately. Your personal data is then purged from our systems within the timeframe described in our Privacy Policy. Notwithstanding the foregoing, Edena Labs retains certain limited categories of data beyond account deletion where required or permitted by law, including data connected to active moderation or legal proceedings, evidence of child sexual abuse material (CSAM) preserved in accordance with legal obligations, and financial records retained for tax and accounting compliance. The deletion of your account does not require Edena Labs to delete such retained data, and Edena Labs may use it in connection with ongoing or future legal proceedings, moderation actions, law enforcement cooperation, or regulatory obligations.

1.2 Communications and Marketing Consent

By creating an account, you consent to receive service-related communications from Edena Labs, including but not limited to push notifications, transactional emails, and in-app messages necessary for the operation of the Service. You may manage your notification preferences at any time through your account settings or device settings. Where required by applicable law, including Canada's Anti-Spam Legislation (CASL), Edena Labs will obtain separate express consent before sending commercial or promotional communications. You may withdraw consent to promotional communications at any time by following the unsubscribe instructions included in such communications.

2. User-Generated Content and Conduct

2.1 User Content

Revv Social allows users to post photos, vehicle builds, videos, comments, and other content ("User Content"). You retain ownership of your User Content, but you grant Edena Labs a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content in connection with the Service.

2.2 Prohibited Content

You agree not to post any User Content that:

• Is illegal, abusive, harassing, or promotes hate speech or violence.
• Contains nudity, sexually explicit material, or spam.
• Infringes on the intellectual property rights of others.
• Discloses private personal information of any individual without their explicit consent, including but not limited to home addresses, phone numbers, or identifying details that could be used to locate, target, or harm any person.
• Promotes, facilitates, or glorifies illegal street racing, reckless driving, or any activity that endangers public safety.

2.3 Child Safety and Zero-Tolerance Policy

Edena Labs has a strict zero-tolerance policy regarding the sexual exploitation of minors. The sharing, distribution, possession, or promotion of child sexual abuse material (CSAM) or any content that sexualizes, exploits, or endangers minors is absolutely prohibited on the Service.

Any account found to be involved in such activity will be permanently banned immediately. Edena Labs will report all confirmed instances of CSAM to the relevant authorities, including but not limited to the National Center for Missing and Exploited Children (NCMEC) and applicable Canadian law enforcement agencies. We cooperate fully with law enforcement investigations and may pursue all available legal remedies, including civil and criminal action, against any individual who violates this policy.

2.4 Your Responsibility for Disclosed Information

You are solely responsible for any personal information you choose to share on the Service, including but not limited to your location, home address, vehicle information, daily routines, or any other identifying details disclosed in posts, build profiles, biographies, or any other publicly visible area of the platform. Edena Labs does not control what personal information you choose to make public, and we are not liable for any consequences arising from information you voluntarily disclose.

2.5 Accuracy of User-Submitted Information

Edena Labs does not verify, validate, or guarantee the accuracy of any information submitted by users on the Service, including but not limited to vehicle specifications, modification details, performance figures, or any other data entered into build profiles or any other area of the platform. Any reliance on user-submitted information is entirely at your own risk. Edena Labs bears no liability for any decision, purchase, or action taken based on information provided by another user on the Service.

3. Meets, Events, and Real-World Activities

3.1 Platform as a Communication Tool

Revv Social is a digital communication platform that allows users to post and discover community-organized automotive gatherings ("Meets" and "Events"). Edena Labs does not organize, host, supervise, sanction, endorse, or participate in any Meet or Event posted on the Service. All Meets and Events are organized solely by the users who create them.

3.2 No Control Over Real-World Conduct

Edena Labs has no ability to control, monitor, or ensure the safety of any real-world activity, gathering, or behavior that occurs in connection with a Meet or Event posted on the Service. The platform functions solely as a tool for community communication. Any decision to attend, organize, or participate in a Meet or Event is made entirely at your own risk.

3.3 Assumption of Risk

By using the Meets and Events features of the Service, you acknowledge and agree that automotive activities, including but not limited to cruises, track days, car shows, and parking lot gatherings, carry inherent risks including property damage, personal injury, and death. You assume full and sole responsibility for any risks associated with your participation in any real-world activity connected to content discovered or posted on the Service.

3.4 Organizer Responsibility

If you create a Meet or Event on the Service, you acknowledge that you are solely responsible for the planning, safety, legality, and conduct of that gathering. You agree that Edena Labs bears no responsibility for anything that occurs at or in connection with any Meet or Event you organize.

3.5 User Due Diligence

Revv Social provides a discovery tool, not a vetting service. Before attending any Meet or Event, engaging with any organizer, or participating in any real-world interaction facilitated through the Service, you are solely responsible for conducting your own due diligence. Edena Labs does not verify the identity, intentions, or legitimacy of any user, organizer, or gathering posted on the platform. You assume full responsibility for any decision to engage in real-world interactions with other users or attend any real-life gathering discovered through the Service.

4. Vehicle and Build Information

4.1 Public Build Profiles

The Service allows users to create public build profiles containing vehicle information, photographs, modification details, and performance specifications. You acknowledge that any information you include in a public build profile is visible to all users of the Service and potentially to the general public.

4.2 Security Risks

Edena Labs does not accept responsibility for any theft, damage, targeting, or harm to you or your vehicle that results from information you choose to make publicly available on the Service, including but not limited to vehicle make, model, color, location, modifications, or performance data. You are solely responsible for assessing the security risks of publicly sharing your vehicle information.

4.3 Third-Party Links and Affiliate Links

Build profiles and other areas of the Service may contain links to third-party websites, products, or services, including affiliate links added by users. Edena Labs does not endorse, verify, or assume any responsibility for the content, accuracy, legality, or practices of any third-party destination linked through the Service. Any interaction you have with a third-party website or service, including any purchase or transaction, is solely between you and that third party. Edena Labs is not liable for any loss or damage of any kind incurred as a result of your use of or reliance on any third-party content, products, or services accessible through the Service.

4.4 Third-Party Review Content

The Service may display business reviews imported from Google. This content is sourced directly from a third-party platform and is not created, verified, moderated, or endorsed by Edena Labs. Edena Labs does not guarantee the accuracy, completeness, or legitimacy of any imported review content, and is not liable for any harm, reputational damage, or loss arising from the display of such content on the Service. Any concerns regarding the accuracy of a Google review should be directed to Google directly.

5. Paid Plans and Subscriptions

5.1 Subscription Tiers

Revv Social offers paid subscription plans that unlock additional features and capabilities beyond the free tier. Details of each plan, including pricing and included features, are made available within the Service and may be updated from time to time.

5.2 Billing and Renewal

Paid subscriptions are billed on a recurring basis (monthly, quarterly, or annually) depending on the plan selected. Your subscription will automatically renew at the end of each billing period unless cancelled prior to the renewal date. By subscribing, you authorize Edena Labs to charge the applicable fees to your payment method on file through the applicable app store or payment processor.

5.3 Cancellation

You may cancel your subscription at any time through your account settings or through the App Store or Google Play Store. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

5.4 No Refunds

All subscription fees are non-refundable. Edena Labs does not issue refunds or credits for partial billing periods, unused features, or unused time remaining on an active subscription. Notwithstanding the foregoing, Edena Labs reserves the right to issue refunds or credits at its sole discretion on a case-by-case basis.

5.5 Changes to Pricing or Features

Edena Labs reserves the right to modify subscription pricing or the features included in any plan at any time. We will provide reasonable notice of any material changes. Your continued use of a paid plan after such changes constitutes your acceptance of the updated terms.

5.6 Service Availability

While Edena Labs makes reasonable efforts to maintain the Service, we do not guarantee uninterrupted access. Temporary outages or feature unavailability do not entitle subscribers to refunds or credits.

6. Prohibited Conduct and Platform Integrity

6.1 Multiple Accounts and Inauthentic Behavior

You may not create or operate multiple accounts for the purpose of circumventing platform limits, restrictions, or enforcement actions. This includes but is not limited to using multiple accounts to artificially inflate engagement on your own content, bypass suspension or ban measures, or manipulate any platform feature that is subject to per-account limits.

6.2 Bots and Automated Abuse

You may not use bots, scripts, automated tools, or any other non-human means to interact with the Service, generate content, inflate engagement metrics, or exploit any platform feature.

6.3 Fake and Misleading Meets or Events

You may not post Meets or Events that are false, misleading, or intended to lure users to a location under false pretenses. Any Meet or Event posted on the Service must represent a genuine, intended gathering.

6.4 Business Account Misrepresentation

Business Accounts must represent a real, legitimate business or professional entity. You may not create a Business Account to misrepresent your identity, spam the Business Hub, or otherwise deceive users or Edena Labs.

6.5 Impersonation

You may not impersonate any individual, business, crew, or entity on the Service, whether real or fictitious. This includes creating accounts, profiles, or content designed to mislead others into believing you are someone you are not. Impersonating Edena Labs employees, moderators, or representatives is strictly prohibited and may result in immediate permanent account termination and legal action.

6.6 Subscription and Billing Abuse

You may not subscribe to a paid plan with the intent to exploit paid features and subsequently initiate fraudulent chargebacks or payment disputes. Any attempt to abuse the billing system will result in immediate account termination and may be pursued through applicable legal and financial remedies.

6.7 Exploitation of Platform Infrastructure

You may not exploit, abuse, or manipulate any technical aspect of the Service, including but not limited to API calls, backend systems, authentication mechanisms, or any other platform infrastructure, in a manner that exceeds normal use or violates these Terms. If such exploitation results in measurable financial damages to Edena Labs Inc., including but not limited to excess infrastructure costs, API usage fees, or operational losses, Edena Labs reserves the right to pursue full legal indemnification for all resulting damages from the responsible party.

6.8 Consequences of Violations

Any violation of this section may result in immediate suspension or permanent termination of your account without notice or refund. Edena Labs reserves the right to take any additional legal action it deems appropriate.

7. Moderation and Enforcement

Edena Labs acts solely as a provider of an interactive computer service and as a neutral host of User Content. Edena Labs is not the author, publisher, or speaker of any User Content posted by users, and any opinions, statements, or content expressed by users are their own. Edena Labs is under no obligation to monitor User Content but reserves the right to do so.

Edena Labs maintains a zero-tolerance policy for abusive content and users. We reserve the right to review, remove, or modify User Content at our discretion.

Any violation of these Terms may result in the immediate suspension or termination of your account without notice. Users can report inappropriate content or block other users directly within the App.

8. Intellectual Property

All rights, title, and interest in and to the Service (excluding User Content), including all software, design, text, and graphics, are and will remain the exclusive property of Edena Labs Inc.

9. Copyright Policy (DMCA)

Edena Labs respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), Edena Labs will respond to valid notices of alleged copyright infringement.

9.1 Filing a Notice

If you believe that content on the Service infringes your copyright, you may submit a written notice to our designated copyright agent containing the following:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing and its location on the Service.
• Your contact information, including name, address, telephone number, and email address.
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

9.2 Designated Copyright Agent

9.3 Counter-Notice and Repeat Infringers

If your content was removed and you believe the removal was in error, you may submit a counter-notice to the same agent. Edena Labs maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.

10. Indemnification

You agree to defend, indemnify, and hold harmless Edena Labs Inc., its officers, directors, employees, contractors, agents, licensors, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of or access to the Service.
• Your User Content.
• Your violation of these Terms.
• Your participation in any real-world Meet, Event, or activity connected to the Service.
• Any harm caused to a third party as a result of your actions, conduct, or content on or off the platform.

11. Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, Edena Labs Inc. shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages of any kind, including but not limited to:

• Personal injury, death, or property damage arising from or related to any Meet, Event, or real-world activity connected to the Service.
• Theft, vandalism, or targeting of any vehicle or property based on information shared on the Service.
• Any harm arising from personal information voluntarily disclosed by a user on the Service.
• Any harm arising from user-to-user interactions, including through Direct Messages or comments.
• Loss of data, revenue, profits, or goodwill.

In no event shall Edena Labs' total cumulative liability to you for any and all claims exceed the greater of (a) the amounts paid by you to Edena Labs in the twelve (12) months preceding the claim, or (b) one hundred Canadian dollars (CAD $100).

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Province of Quebec, Canada. By using the Service, you irrevocably submit to the personal jurisdiction of such courts and waive any objection to the exercise of jurisdiction over you by such courts.

13. Dispute Resolution and Arbitration (United States Users)

This section applies only to users located in the United States. It does not affect the rights of users located in Canada or elsewhere, who remain governed by the Governing Law and Jurisdiction section above.

13.1 Agreement to Arbitrate

If you are a US user, you and Edena Labs agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved through binding individual arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

13.2 Class-Action Waiver

You and Edena Labs agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action or class-wide arbitration.

13.3 Exceptions

Nothing in this section prevents either party from seeking injunctive or equitable relief for matters related to intellectual property, unauthorized access, or misuse of the Service.

13.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to Edena Labs within thirty (30) days of first accepting these Terms. The notice must include your name, account information, and a clear statement that you wish to opt out of arbitration.

14. User Disputes

Edena Labs is not a mediator, arbitrator, or adjudicator of disputes between users. Any conflict arising between users of the Service, including but not limited to disputes over content ownership, crew membership, direct message conduct, or real-world interactions, is solely between the parties involved. Edena Labs bears no liability for the outcome of any user-to-user dispute and is under no obligation to intervene. You agree to release Edena Labs from any and all claims, demands, and damages arising out of or in connection with any such dispute.

15. Crews and Community Features

Crew owners have full authority over their crew, including the ability to remove members, transfer ownership, or disband the crew entirely. Edena Labs is not responsible for any loss of access to crew content, chat history, or community features resulting from crew management decisions made by crew owners or administrators. If a crew is disbanded, members acknowledge that access to associated content and communications may be lost, and Edena Labs bears no liability for such loss.

16. Force Majeure

Edena Labs shall not be liable for any failure or delay in the performance of the Service arising out of or caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, third-party service outages (including cloud infrastructure, database providers, or telecommunications providers), cyberattacks, government actions, or any other event outside Edena Labs' reasonable control. In such circumstances, Edena Labs' obligations under these Terms will be suspended for the duration of the event, and no refunds or credits will be owed to users as a result.

17. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by Edena Labs on the Service, constitute the entire agreement between you and Edena Labs with respect to your use of the Service, and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral, relating to the subject matter herein.

19. No Waiver

The failure of Edena Labs to enforce any right or provision of these Terms at any time shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if made in writing and signed by an authorized representative of Edena Labs.

20. Changes to These Terms

We may modify these Terms at any time. We will notify you of any material changes by updating the "Last updated" date at the top of this document. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.
